I was going to make this argument myself but it has been ably made for me by the editors of the Wall Street Journal. The Afghan prison break is going as much a consequence of Supreme Court meddling as the trials we shall now apparently be forced to go through will be. The prisoners that recently escaped from the Kandahar site would have been, in all likelihood, kept at Guantanamo at less risk and, it is worth pointing out, in more comfort, than they were in country. Needless to say, the courts will suffer no consequences or feel no opprobrium for the consequences of their decisions. Rule of the judges, the rule of the irresponsible.
